Restore Justice at Justice Coalition Seeks Congressional Investigations of<br />
Judge Who Presided Over Trial of Ex-Alabama Governor Don Siegelman<br />
On April 13, 2009, the Restore Justice At Justice coalition, <a href="http://www.restorejusticeatjustice.com">www.restorejusticeatjustice.com</a>, urged Attorney General Eric Holder to identify all those politically prosecuted under the Bush Administration and to then vacate their convictions where appropriate, beginning with Don Siegelman and Paul Minor. However, according to coalition spokesman Brad Friedman, “after almost two months, we have heard nothing from Mr. Holder despite a tidal wave of information about the impropriety of these cases. The Holder DOJ has been quick to dismiss charges against Republicans such as Alaska politicians Ted Stevens, Pete Kott and Vic Kohring for prosecutorial misconduct while taking no corrective action in the cases of Democrats such as Siegelman, Minor and so many others whose cases seem to have been wracked with prosecutorial misconduct.”<br />
• This week, Former Republican Attorney General Richard Thornburgh, after getting charges dismissed against Democrat Cyril Wecht, blasted Bush appointed US Attorney Mary Beth Buchanan for bringing politically motivated cases against 13 Democrats in Pennsylvania <a href="http://tinyurl.com/kqcm9h">http://tinyurl.com/kqcm9h</a><br />

• Last week, journalist-attorney Andrew Krieg documented a career-long abuse of power by Judge Mark Fuller, who presided over Mr. Siegelman’s trial. Judge Fuller withheld information that would have required his recusal from cases because of serious conflicts of interest. <a href="http://tinyurl.com/mhvbxp">http://tinyurl.com/mhvbxp</a><br />

• Two weeks ago, retired Chief Federal Judge U.W. Clemon of Birmingham wrote Mr. Holder seeking a probe of misconduct by Mr. Siegelman’s federal prosecutors, including alleged "judge-shopping," jury-pool "poisoning" and "unfounded" criminal charges in an effort to imprison Siegelman. Judge Clemon had dismissed unfounded charges against Siegelman in the Northern District of Alabama only to have them resurrected by prosecutors before Judge Fuller in the Middle District. <a href="http://tinyurl.com/q8z2jr">http://tinyurl.com/q8z2jr</a><br />

• Three weeks ago, Missouri attorney Paul Weeks stated that Mr. Siegleman was denied a fair trial because Judge Fuller held a “grudge” against him, labored under a conflict of interest, and withheld evidence of his financial involvement in Doss Aviation, which has received more than $300 million in military contracts. <a href="http://tinyurl.com/r8azrm">http://tinyurl.com/r8azrm</a><br />

• Five weeks ago, 75 former state attorneys general from both parties wrote to Mr. Holder noting that Mr. Siegelman raised “gravely troublesome facts” about his prosecution that violates fairness and due process. <a href="http://tinyurl.com/lrjylh">http://tinyurl.com/lrjylh</a><br />

The evidence appears overwhelming that the Bush Administration targeted Democrats for political prosecution, that Mr. Siegelman’s case was corrupted at multiple levels, and that Judge Fuller should have recused himself from Mr. Siegelman’s case. Attorney General Holder must take immediate decisive action concerning Siegelman’s conviction and others in order to restore justice at his Department of Justice. We urge Congress to weigh in and insist on an investigation and corrective action without further delay.<br />
